Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the RiteGiving platform, including the website at www.RiteGiving.com, all related pages, features, tools, and services (collectively, the “Platform”). The Platform is operated by RiteGiving Ltd. (“RiteGiving,” “we,” “our,” or “us”), a company incorporated under the laws of Jamaica.
By accessing or using the Platform — whether as a campaign creator, donor, volunteer, event participant, or general visitor — you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.
These Terms constitute a legally binding agreement between you and RiteGiving. Please read them carefully.
1. Definitions
In these Terms, the following definitions apply:
“Platform” means the RiteGiving website, mobile applications, and all associated services available at www.RiteGiving.com.
“User” means any person who accesses or uses the Platform, including Campaign Creators, Donors, Volunteers, and Event Participants.
“Campaign Creator” means a User who creates and manages a fundraising campaign on the Platform.
“Donor” means a User who makes a financial contribution to a campaign on the Platform.
“Volunteer” means a User who registers their availability and skills to support campaigns or events listed on the Platform.
“Event Participant” means a User who books or registers to attend an event listed on the Platform.
“Campaign” means a fundraising initiative created and published on the Platform by a Campaign Creator.
“Funds” means monetary contributions made by Donors to a Campaign through the Platform.
“Content” means any text, images, videos, descriptions, documents, or other materials uploaded, submitted, or shared on the Platform.
“Platform Fee” means the fee charged by RiteGiving for facilitating transactions on the Platform, as set out in Section 7.
“Jamaican Law” means the laws of Jamaica, including but not limited to the Electronic Transactions Act, the Consumer Protection Act, the Data Protection Act 2020, and the Proceeds of Crime Act.
2. Eligibility
To use the Platform, you must:
Be at least 18 years of age.
Have the legal capacity to enter into a binding agreement under Jamaican law.
Not be prohibited from using the Platform under any applicable law or regulation.
Provide accurate, current, and complete information when creating an account or submitting a Campaign.
By using the Platform, you represent and warrant that you meet all eligibility requirements. If you are registering on behalf of an organization, charity, or company, you further represent that you have authority to bind that entity to these Terms.
RiteGiving reserves the right to refuse access or terminate accounts of users who do not meet eligibility requirements.
3. Account Registration
3.1 Creating an Account
To access most Platform features, you must register for an account. When registering, you agree to:
Provide accurate, truthful, and complete information.
Keep your account information up to date at all times.
Choose a strong password and keep it confidential.
Not share your account credentials with any third party.
Notify us immediately at support@ritegiving.com if you suspect unauthorized access to your account.
3.2 Account Responsibility
You are solely responsible for all activities that occur under your account, whether or not authorized by you. RiteGiving shall not be liable for any loss arising from unauthorized use of your account where you have failed to take reasonable steps to keep your credentials secure.
3.3 One Account Per User
Each individual or organization may maintain only one account on the Platform. Creating multiple accounts to circumvent restrictions, bans, or Platform limits is prohibited and may result in permanent suspension.
3.4 Account Suspension and Termination
RiteGiving reserves the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have:
Violated these Terms or our Community Guidelines.
Provided false or misleading information.
Engaged in fraudulent, abusive, or illegal activity.
Posed a risk to other users, donors, or the integrity of the Platform.
4. Campaigns
4.1 Creating a Campaign
Any eligible User may create a fundraising Campaign on the Platform. By creating a Campaign, you agree that:
All information provided in the Campaign is truthful, accurate, and not misleading.
You have the legal right to raise funds for the stated purpose.
The Campaign complies with all applicable Jamaican laws and regulations, including laws relating to charitable solicitation and financial transactions.
You will use all Funds raised solely for the stated Campaign purpose.
You will provide updates to Donors on the progress and use of Funds.
4.2 Campaign Review
RiteGiving reserves the right to review, approve, reject, suspend, or remove any Campaign at our sole discretion, including where we have reason to believe the Campaign:
Is fraudulent, misleading, or deceptive.
Violates these Terms or our Community Guidelines.
Violates any Jamaican law or regulation.
Poses a risk to the Platform, its users, or the public.
Campaign review does not constitute an endorsement of any Campaign by RiteGiving. We do not verify all information submitted by Campaign Creators and do not guarantee the accuracy of Campaign descriptions.
4.3 Campaign Duration and Funding
Campaign Creators must set a fundraising goal and campaign end date when creating a Campaign. RiteGiving operates on a “keep-what-you-raise” model.
Keep-What-You-Raise: Campaign Creators receive all Funds collected, minus Platform Fees and payment processing fees, regardless of whether the fundraising goal is met.
4.4 Prohibited Campaigns
The following types of Campaigns are strictly prohibited on the Platform:
Campaigns intended to fund illegal activities or organizations.
Campaigns promoting hate speech, discrimination, or violence against any person or group.
Campaigns involving the sale of controlled substances, weapons, or counterfeit goods.
Campaigns that misrepresent the identity of the Campaign Creator or the intended beneficiary.
Campaigns that involve self-harm, exploitation, or any activity harmful to minors.
Campaigns that seek to raise funds for personal gambling or speculative financial activities.
Any other Campaign that RiteGiving determines, at its sole discretion, to be inappropriate for the Platform.
Violation of this Section may result in immediate Campaign removal, account suspension, and referral to the relevant Jamaican authorities.
4.5 Campaign Creator Obligations
Campaign Creators are solely responsible for:
The accuracy and completeness of all Campaign information.
Fulfilling any promises or rewards offered to Donors.
Communicating with Donors regarding Campaign progress and use of Funds.
Complying with all applicable laws, including tax obligations relating to Funds received.
Providing identity verification documents to RiteGiving upon request.
5. Donations
5.1 Making a Donation
By making a donation through the Platform, you acknowledge and agree that:
Donations are voluntary contributions and are not purchases of goods or services.
RiteGiving does not guarantee that a Campaign will achieve its fundraising goal or that Funds will be used as described by the Campaign Creator.
Campaigns where the goal is not met, donations are generally non-refundable once processed.
You are responsible for verifying the legitimacy and credibility of any Campaign before donating.
5.2 Refund Policy
Refunds may be issued in the following circumstances:
Campaign Removed by RiteGiving: if RiteGiving removes a Campaign for violating these Terms before Funds are disbursed, we will endeavor to refund donations where technically and practically possible. RiteGiving does not guarantee full recovery of Funds where the Campaign Creator has already received a disbursement.
Fraudulent Campaign: if a Campaign is determined to be fraudulent, RiteGiving will work with relevant authorities and payment processors to attempt recovery of Funds, but cannot guarantee a full refund.
To request a refund, contact support@ritegiving.com with your donation reference number.
5.3 Donation Anonymity
Donors may choose to make their donation publicly visible (displaying their name and message on the Campaign page) or anonymous. Anonymous donations will not be disclosed to the Campaign Creator or displayed publicly.
5.4 Tax
Donations made through RiteGiving may or may not be tax-deductible under Jamaican law depending on the nature of the Campaign and the legal status of the Campaign Creator. RiteGiving does not provide tax advice. Donors should consult a qualified tax professional regarding the deductibility of their donations.
6. Volunteers
6.1 Volunteer Registration
Users may register as Volunteers on the Platform to offer their time and skills to support Campaigns or Events. By registering as a Volunteer, you agree that:
The information you provide about your skills, experience, and availability is accurate and current.
You will engage with Campaign Creators and Event Organizers in a respectful, professional, and lawful manner.
You will comply with any reasonable requirements set by the Campaign Creator or Event Organizer.
You are not entitled to payment from RiteGiving for your volunteer activities, unless a specific arrangement has been agreed in writing with the Campaign Creator or Event Organizer.
6.2 Volunteer Relationship
Volunteers are independent individuals and are not employees, agents, or contractors of RiteGiving. RiteGiving acts solely as a platform to connect Volunteers with Campaign Creators and Event Organizers. RiteGiving is not responsible for the conduct of Volunteers or for any disputes between Volunteers and Campaign Creators or Event Organizers.
6.3 Volunteer Safety
RiteGiving encourages all Volunteers to exercise reasonable care and good judgment when engaging in volunteer activities. RiteGiving does not conduct background checks on Volunteers and cannot guarantee the safety of volunteer activities. Volunteers participate at their own risk.
7. Events
7.1 Event Listings
Campaign Creators and approved organizers may list events on the Platform. Events may be free or ticketed. By listing an event, the organizer agrees that:
All event information is accurate, including the date, time, location, and description.
The event complies with all applicable Jamaican laws, including public health regulations and event permits where required.
Participants will be treated with respect and in accordance with RiteGiving’s Community Guidelines.
7.2 Booking an Event
Users may book events through the Platform. By booking an event, you agree that:
You will attend the event in compliance with the organizer's terms and any applicable rules.
For ticketed events, payment must be completed at the time of booking.
Cancellations and refunds for event bookings are subject to the individual organiser’s cancellation policy, which will be displayed at the time of booking.
7.3 Event Cancellation by Organiser
If an event is cancelled by the organiser, RiteGiving will endeavour to process refunds for all ticket purchases within 10 business days. RiteGiving’s liability in the event of cancellation is limited to the face value of tickets purchased through the Platform.
7.4 RiteGiving’s Role in Events
RiteGiving provides the booking infrastructure for events but is not an event organiser. We are not responsible for the quality, safety, or delivery of any event listed on the Platform. Any disputes regarding event quality or delivery must be addressed directly with the event organiser.
8. Platform Fees and Payments
8.1 Platform Fee
RiteGiving charges a Platform Fee on all successful Campaign disbursements. The current Platform Fee is displayed on our Pricing page at www.RiteGiving.com/pricing and may be updated from time to time. We will provide at least 30 days’ notice of any fee changes.
The Platform Fee is deducted automatically from Funds before disbursement to Campaign Creators. Donors are not charged the Platform Fee directly, though they may choose to cover the fee on behalf of the Campaign Creator at the point of donation.
8.2 Payment Processing Fees
In addition to the Platform Fee, payment processing fees are charged by our third-party payment processors. These fees are separate from the Platform Fee and vary by payment method. Current processing fees are displayed at checkout.
8.3 Disbursement
Funds will be disbursed to Campaign Creators within 5–10 business days after the Campaign end date, subject to:
Successful identity verification of the Campaign Creator.
No pending investigation, dispute, or legal hold on the Campaign or associated account.
Compliance with all applicable Jamaican anti-money laundering requirements.
RiteGiving reserves the right to delay or withhold disbursement where there is a reasonable suspicion of fraud, misuse of Funds, or violation of these Terms.
8.4 Currency
All transactions on the Platform are processed in Jamaican Dollars (JMD) unless otherwise specified. Where international payment methods are used, currency conversion will be applied at the prevailing rate of the payment processor.
8.5 Taxes
Campaign Creators are solely responsible for determining and fulfilling any tax obligations arising from Funds received through the Platform, including General Consumption Tax (GCT) and income tax under Jamaican law. RiteGiving does not withhold taxes on behalf of Campaign Creators and does not provide tax advice.
9. User Content
9.1 Your Content
You retain ownership of any Content you submit to the Platform. By submitting Content, you grant RiteGiving a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, display, distribute, and adapt your Content for the purposes of operating, promoting, and improving the Platform.
You represent and warrant that:
You own or have the necessary rights to submit the Content.
The Content does not infringe the intellectual property rights, privacy rights, or other legal rights of any third party.
The Content is accurate and not misleading.
The Content complies with these Terms and our Community Guidelines.
9.2 Prohibited Content
You must not submit Content that:
Is false, misleading, or fraudulent.
Is defamatory, abusive, harassing, threatening, or hateful.
Infringes any copyright, trademark, or other intellectual property right.
Contains pornographic, obscene, or sexually explicit material.
Exploits or harms minors in any way.
Promotes or facilitates illegal activity.
Contains viruses, malware, or other harmful code.
Violates the privacy of any individual.
9.3 Content Removal
RiteGiving reserves the right to remove any Content that violates these Terms or our Community Guidelines, without prior notice. We may also report Content to the relevant Jamaican authorities where required by law.
10. Intellectual Property
All intellectual property on the Platform that is not User Content — including but not limited to the RiteGiving name, logo, trademarks, software, platform design, text, and graphics — is owned by or licensed to RiteGiving Ltd. and is protected by Jamaican and international intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Platform intellectual property without our prior written consent. Unauthorised use of our intellectual property may result in legal action.
11. Anti-Money Laundering and Financial Compliance
RiteGiving is committed to complying with all applicable Jamaican financial laws and regulations, including the Proceeds of Crime Act and requirements administered by the Financial Services Commission (FSC) and the Bank of Jamaica.
By using the Platform, you agree that:
All Funds raised or donated through the Platform come from legitimate sources.
You will not use the Platform to launder money, finance terrorism, or engage in any other prohibited financial activity.
You will cooperate with any identity verification or due diligence request made by RiteGiving.
RiteGiving may file Suspicious Activity Reports with the relevant Jamaican authorities where required by law, without prior notice to you.
RiteGiving reserves the right to freeze, withhold, or reverse transactions where we have reasonable grounds to suspect financial crime. We may share information with law enforcement and regulatory authorities without your consent where required by law.
12. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and processing of your personal information as described in our Privacy Policy, available at www.RiteGiving.com/privacy.
We process personal information in accordance with the Data Protection Act, 2020 of Jamaica.
13. Prohibited Conduct
In addition to the specific prohibitions set out elsewhere in these Terms, you must not:
Use the Platform for any unlawful purpose or in violation of any Jamaican law or regulation.
Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
Attempt to gain unauthorised access to the Platform, its servers, or any account other than your own.
Use automated tools, bots, scrapers, or scripts to access or collect data from the Platform without our written consent.
Interfere with or disrupt the integrity or performance of the Platform.
Attempt to reverse-engineer, decompile, or disassemble any part of the Platform.
Use the Platform to send unsolicited communications (spam) to other users.
Engage in any conduct that restricts or inhibits any other user from using or enjoying the Platform.
Resell, transfer, or exploit your access to the Platform for any commercial purpose without our prior written consent.
14. Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY JAMAICAN LAW, RITEGIVING DISCLAIMS ALL WARRANTIES, INCLUDING:
Warranties of merchantability, fitness for a particular purpose, and non-infringement.
Warranties regarding the accuracy, completeness, or reliability of any Campaign, Content, or information on the Platform.
Warranties that the Platform will be uninterrupted, error-free, or free of viruses or harmful components.
RiteGiving does not endorse, verify, or guarantee any Campaign, Campaign Creator, Volunteer, or Event listed on the Platform.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY JAMAICAN LAW, RITEGIVING AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY:
Indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
Loss of Funds arising from fraudulent Campaigns or misuse of donations by Campaign Creators.
Loss of data, business, revenue, or profits arising from Platform downtime or errors.
Conduct of any User, Volunteer, Campaign Creator, or Event Organiser on or off the Platform.
In no event shall RiteGiving’s total aggregate liability to you for any claims arising from your use of the Platform exceed the greater of (a) the amount of Platform Fees paid by you to RiteGiving in the 12 months preceding the claim, or (b) JMD $50,000.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under Jamaican law.
16. Indemnification
You agree to indemnify, defend, and hold harmless RiteGiving Ltd. and its directors, officers, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
Your breach of these Terms or our Community Guidelines.
Your Content or your Campaign.
Your violation of any applicable Jamaican law or regulation.
Any dispute between you and another User, Donor, Volunteer, or Event Organiser.
Any claim by a third party that your Content infringes their rights.
17. Dispute Resolution
17.1 Informal Resolution
We encourage you to contact us first if you have any dispute, concern, or complaint about the Platform. Please reach out to our support team at support@ritegiving.com. We will endeavour to resolve the matter within 30 days.
17.2 Governing Law
These Terms are governed by and construed in accordance with the laws of Jamaica. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Jamaica.
17.3 Dispute Between Users
RiteGiving is not responsible for disputes between Users, including disputes between Campaign Creators and Donors, or between Event Organisers and participants. We may, at our sole discretion, attempt to mediate disputes where Platform transactions are involved, but we are under no obligation to do so.
18. Modifications to the Platform and Terms
18.1 Changes to the Platform
RiteGiving reserves the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.
18.2 Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
Post the updated Terms on this page with a revised “Last Updated” date.
Notify registered Users by email at least 14 days before the changes take effect.
Display a prominent notice on the Platform.
Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and may request account deletion.
19. Termination
Either party may terminate the relationship governed by these Terms at any time. You may close your account by contacting support@ritegiving.com. RiteGiving may terminate or suspend your account in accordance with Section 3.4.
Upon termination:
Your right to access the Platform ceases immediately.
Any active Campaigns associated with your account may be terminated, and Funds held in trust will be handled in accordance with our refund procedures.
Sections 10 (Intellectual Property), 15 (Limitation of Liability), 16 (Indemnification), 17 (Dispute Resolution), and any other provisions that by their nature should survive, will survive termination.
20. Miscellaneous
20.1 Entire Agreement
These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and RiteGiving with respect to your use of the Platform and supersede all prior agreements and understandings.
20.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable under Jamaican law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
20.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing to be effective.
20.4 Assignment
You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent. RiteGiving may assign its rights and obligations under these Terms to a successor entity in the event of a merger, acquisition, or sale of assets.
20.5 Force Majeure
RiteGiving shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of government, civil unrest, internet outages, or other force majeure events.
20.6 Language
These Terms are written in English. In the event of any conflict between an English version and a translated version, the English version shall prevail.
